Chauvin knelt on Floyd for more than nine minutes calling out to his mother, repeatedly saying he couldn’t breathe. He is charged with second degree murder, third degree murder, and second degree manslaughter.
His attorney, Eric Nelson, began the day of the trial Wednesday by asking the court for an acquittal, a common strategy for defense lawyers, New York Times reporter John Eligon wrote in the newspaper’s live coverage. Nelson tried to argue that coroner Andrew Baker described Floyd’s death as just murder “for medical purposes.”
“As expected, Judge Peter A. Cahill denies this,” Eligon wrote.
Another decision by Cahill hampered the defense’s attempt to identify Floyd as his own killer because of his drug addiction. It was a connection attempt with the accused drug dealer Morries Lester Hall, a friend of Floyd, who was with him before he died. Hall took position on Wednesday to officially enforce his privilege of the fifth amendment to self-accusation that his attorney had warned against for several days. Adrienne Cousins, Hall’s attorney, said in court Wednesday that her client’s car had been searched twice and drugs were found in it on both occasions. “If he gets in that car, he exposes himself to possession charges,” said the lawyer. Cahill found her reasoning valid, and the trial went on without Hall’s testimony.
The interview focused on Fowler, a former chief medical officer in Maryland. The doctor retired from his position in 2019 and is currently named in a lawsuit filed by the von’s family Anton Black, another black man who was killed by the police. “As a medical examiner in Maryland, Fowler claimed Anton died of natural causes and said his bipolar disorder was more of a factor than the weight placed on Anton while facing down by three white officers and a white civilian was held, “the Maryland ACLU said in a press release on Wednesday.
Sonia Kumar, a senior attorney for the organization, said in a statement that “under the direction of Dr. Fowler,” the Maryland Medical Examiner’s Office “was complicit in creating false accounts of what kills black people in police encounters, including Tyrone West, Tawon Boyd, Anton Black and too many others. “She added:
“The doctor’s office decided that Anton Black’s death was not a murder, even though the video showed that the police were chasing him, verbally abusing him, and putting him face down on the floor after he was handcuffed and to it Time had stopped breathing. The coroner blamed Anton for his own death – heaped false claims about laced drugs, a heart condition, and even Anton’s bipolar disorder – instead of the police who killed him. The family had to pay for outside experts to understand what really killed Anton. “
And so began Fowler’s testimony in the Chauvin case.
Fowler testified in court that he believed Floyd had an arrhythmia and that his history of drug use, heart disease and carbon monoxide exposure from the patrol car during his incarceration contributed to the arrhythmia. “All of them together caused Mr. Floyd’s death,” said Fowler.

Let the doctor tell because Floyd’s neck wasn’t injured. it wasn’t really affected either. “It suggests the force exerted on Mr. Floyd was less than enough to injure him,” said Fowler.

But in this case, compounded by multiple clips of body camera footage, witness videos, and surveillance clips, Fowler couldn’t completely bend the truth to his will. Blackwell was able to tear down his reasoning point by point – or more precisely, get the doctor to tear down his own reasoning. Fowler admitted he didn’t see any air monitoring data telling him how much, if any, carbon monoxide was in Floyd’s breathing zone. Fowler agreed on the charges that even if Chauvin and other officials weren’t on Floyd’s neck, their weight on a person’s stomach or torso could also cause compression or positional asphyxia, a lack of oxygen flow to the brain.
“If it exceeds the 225 pound limit found in multiple studies, your argument is correct,” said Fowler.

He had previously said: “Talking and making noise is very good evidence that the airways are not closed.”
This report contradicts that of the law enforcement witnesses, Martin Tobin, a Chicago pulmonologist and intensive care doctor, and Bill Smock, an emergency doctor. “Mr. Floyd died of positional suffocation, which is a fancy way of saying he died because he ran out of oxygen,” Smock said in previous statements. Tobin explained that the oxygen levels in Floyd’s body were on Zero had dropped and at this point in time “there is no more ounce of oxygen in his body”.
